The two men who were accused of violent disorder at a promotion fete in Wotton, Christ Church, over six years ago, walked free from the No. 5 Supreme Court on Monday.
Shane Anthony Burke, formerly known as Shane Anthony Greene, 26, of Ashby Land, Lodge Road, Christ Church, and Akem Marvon Waithe, 30, of Greens, St George, were jointly accused that being present together with other people on September 1, 2016, they used unlawful violence and their conduct taken together was such as would cause people present to fear for their personal safety.
Waithe was solely accused of using a firearm, on the same date, without the required licence.
Senior State Counsel Rudolph Burnett prosecuted, while King’s Counsel Michael Lashley and attorneys Justin Leacock, Sade Harris and Zudie Payne represented Waithe.
Greene was represented by attorney Rasheed Belgrave.
Yesterday, Belgrave and Leacock made no-case submissions, arguing that all of the prosecution eyewitnesses had recanted their evidence and there was no other evidence or insufficient evidence linking the two accused to the incident.
Justice Pamela Beckles upheld the submissions and subsequently told the two men they were free to go. (HLE)
