Two challenge convictions

Convicted men Bryan O’Neal Small and Jason Omar Morgan are challenging the sentences they got from the No. 3 Supreme Court in May last year.

Small, a spray painter, of Martin’s Road, the Pine, and Morgan, a self-employed vendor, of Waterford Housing Area, both in St Michael, were convicted for having articles for use in connection with theft – two pairs of gloves, two ski masks and a torch – while not being at their places of abode on October 11, 2013.

Small was also convicted for having a 9mm semi-automatic pistol and ten rounds of ammunition on the same date.

Justice Carlisle Greaves jailed Small for 15 years for the gun, ten years for having the ammunition and five years for having the articles. The 1 416 days Small spent on remand were deducted and the sentences ordered to run concurrently.

Morgan was sentenced to five years for the articles and his 176 days on remand were also ordered deducted. They have since appealed their convictions and sentences. (HLE)
