The state has failed to prove its case against Herwin Llewellyn Burrowes.
This was the contention of defence attorney Rhea Layne as she made her closing address to the jury in the No. 4 Supreme Court yesterday.
Burrowes, of Taylor’s Gap, Delamere Land, St Michael, is accused of, having been arrested for unlawful possession of cannabis on June 9, 2018, he escaped custody using force while at Temple Yard, the City.
The defence attorney said Temple Yard was known as a place where people smoke.
“It doesn’t mean the accused was the one smoking. If the police grabble on ’pon you, you would want to do the same thing. He did what any reasonable person, in his position, would have done,” Layne told the jury.
The defence attorney argued the State had failed to produce the quality of evidence to convict the accused. (HLE)
