The Judicial Review brought by Dr Sahle Griffith against Coroner Graveney Bannister’s decision into the death of Warren Mottley suffered a setback yesterday as the presiding judge recused herself amid claims of “apparent bias”.
The matter has now been adjourned pending its transfer to another judge.
The outcome has not gone down well with the attorneys for Griffith.
“Unless a case is to be properly shielded from public scrutiny on the basis of national security or other justified privacy, justice is only properly done when it is done in public,” Senior Counsel Ralph Thorne told the Daily Nation.
“The public is now therefore entitled to wonder at an application that is made for a judge’s recusal on the cusp of final argument,” he said. (HLE)
